Annies Mailbag: Is Seller Obligated to Repair Floor to Close?

Washington REALTORS® Legal Hotline Lawyer gets questions JUST like this almost daily...

"Buyers are requesting seller fix a stain in the wood floors. The stain was not noticed until the buyer's final walkthrough and it was not noticed by the seller until they removed their large rug and the furniture, which had sat on the rug for the last 10 years. Seller moved out and buyers came by for a walkthrough. Seller does not feel obligated to repair the flooring as she was unaware of it until she moved her belongings. Buyer feels that seller is obligated to pay for the repair and that it was misrepresentation. Can buyer delay closing? Will buyer lose earnest money?"
